O propriet\u00e1rio de um im\u00f3vel num condom\u00ednio ou complexo de apartamentos que pretenda vender, doar, ou dispensar de qualquer forma o im\u00f3vel, \u00e9 obrigado a solicitar que o Administrador do Condom\u00ednio emita um documento escrito que declare todas as despesas e d\u00edvidas do condom\u00ednio. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Isto inclui, mas n\u00e3o est\u00e1 limitado a:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>A natureza das despesas, por exemplo: \u00a0<\/strong><ul><li>Limpeza das \u00e1reas comuns<\/li><\/ul><ul><li>Manuten\u00e7\u00e3o de elevadores<\/li><\/ul><ul><li>Trabalho de base<\/li><\/ul><ul><li>Repara\u00e7\u00e3o e manuten\u00e7\u00e3o do telhado e das paredes exteriores<\/li><\/ul><\/li><li><strong>O respetivo montante<\/strong><ul><li>Custo dos servi\u00e7os individuais<\/li><\/ul><ul><li>Dados dos empreiteiros contratados para a execu\u00e7\u00e3o das obras<\/li><\/ul><\/li><li><strong>Condi\u00e7\u00f5es de pagamento<\/strong><ul><li>Prazos de pagamento<\/li><\/ul><ul><li>Repercuss\u00f5es em caso de incumprimento<\/li><\/ul><ul><li>M\u00e9todos de pagamento<\/li><\/ul><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">O documento deve tamb\u00e9m incluir quaisquer d\u00edvidas pr\u00e9-existentes a prestadores de servi\u00e7os relacionadas com o im\u00f3vel que vai ser vendido ou transferido.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A natureza da d\u00edvida<\/li><li>O montante total da d\u00edvida, incluindo um historial de juros acrescidos<\/li><li>As datas das d\u00edvidas e quando devem ser pagas<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A declara\u00e7\u00e3o de d\u00edvidas imobili\u00e1rias deve ser emitida pela Administra\u00e7\u00e3o do Condom\u00ednio no prazo de dez dias ap\u00f3s o pedido do propriet\u00e1rio. O documento \u00e9 obrigat\u00f3rio e deve ser apresentado aquando da reda\u00e7\u00e3o dos documentos de venda ou do reconhecimento notarial da escritura de venda ou de transfer\u00eancia de propriedade. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c9 importante saber que esta declara\u00e7\u00e3o \u00e9 obrigat\u00f3ria, a n\u00e3o ser que o comprador declare na escritura da propriedade que est\u00e1 disposto a renunciar \u00e0 declara\u00e7\u00e3o e aceita tornar-se respons\u00e1vel por qualquer d\u00edvida que o vendedor possa ter acumulado durante o seu per\u00edodo de propriedade.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Despesas obrigat\u00f3rias para os cond\u00f3minos, relativas \u00e0 manuten\u00e7\u00e3o dos espa\u00e7os e equipamentos comuns.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A nova lei introduzida em abril de 2022 foi concebida para clarificar a responsabilidade pelas despesas relacionadas com apartamentos e condom\u00ednios.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A partir de 2022, as despesas associadas \u00e0 manuten\u00e7\u00e3o e conserva\u00e7\u00e3o dos espa\u00e7os comuns e o pagamento destes servi\u00e7os ser\u00e3o da exclusiva responsabilidade do propriet\u00e1rio do im\u00f3vel no momento em que as despesas forem decididas, sendo devidas proporcionalmente ao valor do im\u00f3vel do propriet\u00e1rio - salvo acordo em contr\u00e1rio.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Outra altera\u00e7\u00e3o diz respeito ao custo das \u00e1reas comuns que s\u00e3o utilizadas exclusivamente por um \u00fanico propriet\u00e1rio. Estas zonas podem incluir varandas e p\u00e1tios de uso exclusivo. Quando os trabalhos de manuten\u00e7\u00e3o e repara\u00e7\u00e3o destes espa\u00e7os afectarem outras \u00e1reas comuns do edif\u00edcio, o propriet\u00e1rio respons\u00e1vel por estas \u00e1reas exclusivas deve garantir que estas \u00e1reas s\u00e3o limpas e devolvidas a um estado satisfat\u00f3rio durante e ap\u00f3s a conclus\u00e3o dos trabalhos na sua \u00e1rea exclusiva.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Responsabilidade por encargos de condom\u00ednio<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A responsabilidade dos encargos, e a forma como estes acompanham o im\u00f3vel, foi agora clarificada com a introdu\u00e7\u00e3o da Lei 08\/2022. A responsabilidade da d\u00edvida de condom\u00ednio tem sido uma quest\u00e3o que tem sido discutida nos tribunais portugueses h\u00e1 muitos anos, e a introdu\u00e7\u00e3o desta lei tem como objetivo acabar com o debate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequentemente, o momento em que \u00e9 devido o pagamento de um servi\u00e7o \u00e9 agora o momento-chave para identificar a responsabilidade pela d\u00edvida. S\u00f3 se o comprador do im\u00f3vel declarar expressamente na escritura que est\u00e1 disposto a assumir a d\u00edvida antes de tomar posse do im\u00f3vel, \u00e9 que ser\u00e1 respons\u00e1vel por<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Assim, em qualquer d\u00edvida ao condom\u00ednio, o momento em que o pagamento \u00e9 devido \u00e9 agora o momento chave para determinar a responsabilidade pelo pagamento. Se \u00e9 o anterior propriet\u00e1rio ou aquele que adquiriu o im\u00f3vel.
